Specifically, there are three important points about “can you give talaq during Ramadan?” which I will explain in this article. The three important things I mean are as follows:

When Is Talaq Allowed in Islam?

The first important thing about “can you give talaq during Ramadan?” what I will explain now is "when is talaq allowed in Islam?". I want you to understand that first before you read more explanations in this article so that you understand the right time to give talaq.

One important thing about the right time to give talaq that I want to explain is that a good talaq is a talaq that fulfills all the talaq rules or conditions for talaq. Therefore, you must understand all of this if you want to understand "when is talaq allowed in Islam?".

So, firstly, I will explain the rules of talaq in Islam or the conditions of talaq in Islam.

Rules of Talaq in Islam

In simple terms, the rules of talaq in Islam or the terms of talaq in Islam are as follows:

  • The husband who gave the talaq was mature, not forced, and conscious.

The first rule of talaq or the first requirement of talaq is that the husband who gives talaq is baligh (adult), is not forced to do talaq, and is aware that it is talaq. In other words, if your husband is immature, then he cannot give you talaq. If your husband is forced or unconscious, then the talaq is invalid, unless the court is forcing it.

  • The divorced wife in a chaste condition (not during haid) and not after sex.

The second rule of talaq or the second condition of talaq is that the divorced wife is in a pure condition and not after sex. In other words, if you are in an impure condition, such as if you are menstruating or postpartum, or if you have had sex with your husband, then talaq is valid but it is haram: your husband should not give you talaq if you are menstruating, postpartum, or after sex.

We can find an explanation that Islam strictly forbids a husband from giving talaq to his wife who is menstruating in the hadith below:

From Abdullah ibn Umar radiyallahu anhuma, that he had divorced his wife when shewas menstruating during the time of Allah's Messenger (Prophet Muhammad) sallallahu alaihi wa sallam (divorced one). Umar bin Khattab radliyallahu anhu then asked the Messenger of Allah (Prophet Muhammad) salallahu alayhi wa sallam about it, (Allah's messenger sallallahu alayhi wa sallam then got angry). Then Allah's Messenger said, "Tell him to return to his wife (cancel talaq), then tell him to maintain her until she is pure (ends menstruation), then she has a second period, then she is pure (ends menstruation) second). Then if after that he wants to defend her, then he may defend her. If he wants to divorce her, then he may divorce her. Those are the rules about divorcing wives that Allah has commanded.” This hadith was narrated by al-Bukhari and Muslim. In a Muslim narration it is explained (another hadith editor), "Tell him to return to his wife and then divorce her in a holy state or while pregnant."

Now I want to give you a specific answer to the question “when is talaq allowed in Islam?”. So, if we have understood some of the explanations in the paragraphs above, then we can conclude that talaq is permissible in Islam when all the rules of talaq or all the conditions of talaq are met. That's the answer.

That is a brief explanation of "when is talaq allowed in Islam?". As Muslims, we must understand that.

Can You Give Talaq During Ramadan?

The second important thing about “can you give talaq during Ramadan?” what I'm going to explain now is a specific answer. I want you to understand that because that is the main topic in this discussion.

In the previous few paragraphs I have explained that the best time to give talaq to the wife is when all the talaq rules or all the talaq conditions are met. In Islamic legal literacy, as I understand it, there is no certain day, certain month, and certain year that Muslims are allowed to give talaq to their wives or not to give talaq to their wives.

So, if you ask me, "can you give talaq during Ramadan?", the answer is that you can give talaq during Ramadan if all the rules of talaq or all the conditions of talaq are met. All the rules of talaq or all the conditions of talaq become the standard to determine whether a husband may give talaq to his wife or not.

But what we must understand is that Ramadan is a very noble month for Muslims. Talaq is something that is allowed in Islam but is not recommended. For this reason, ethically, talaq should not be given during Ramadan. The goal is honoring Ramadan. Unless talaq is the best option.

That's a brief explanation of "can you give talaq during Ramadan?". As Muslims, we must understand that. I want you to understand that because that is the main topic of this discussion.

How to Give Talaq During Ramadan?

The third important thing about “can you give talaq during Ramadan?” what I will explain now is "how to give talaq during Ramadan?". I want you to understand that so that you understand what you have to do if you are forced to give talaq to your wife during Ramadan.

In simple terms, if we read some Islamic legal literature on talaq, then we can conclude that there are two ways to give talaq during Ramadan. The two ways I mean are as follows:

  • Say talaq to wife with niyyah for talaq.
  • Giving talaq in writing to the wife with niyyah for talaq.

That's a brief explanation of "how to give talaq during Ramadan?". As Muslims, we must understand that.

That's a brief explanation of "can you give talaq during Ramadan?" and some important things about it. Do you understand? If you want to ask, please ask!

I think that's enough for this article. Hope it is useful. Amen.

See you again in the next article!
